DOJ orders the arrest of two judges
No more playing games
Federal authorities arrested Milwaukee County Circuit Court Judge Hannah Dugan on Friday morning, charging her with obstruction related to an immigration enforcement operation, according to FBI Director Kash Patel.
The arrest occurred at the Milwaukee County Courthouse around 8:30 a.m. local time, as confirmed by a U.S. Marshals Service spokesperson. The charges stem from an incident on April 18, when Immigration and Customs Enforcement (ICE) agents attempted to arrest Eduardo Flores-Ruiz, a Mexican national, at the courthouse following his appearance in Dugan’s courtroom for a pretrial hearing on misdemeanor battery charges.
According to a criminal complaint, Dugan is accused of directing Flores-Ruiz and his attorney through a nonpublic jury door, which led to a private area of the courthouse, allegedly to help him avoid arrest. The complaint states that multiple witnesses, including courtroom staff, reported Dugan appeared upset upon learning of the ICE agents’ presence and questioned the validity of their administrative warrant, asserting a judicial warrant was required. After a brief foot chase, federal agents pursued and apprehended Flores-Ruiz outside the courthouse.
The charges & the reactions
The complaint charges Dugan, who was elected to the Milwaukee County Circuit Court in 2016 and re-elected in 2022, with obstructing a federal proceeding and concealing an individual to prevent arrest. If convicted, she faces up to five years in prison for obstruction, one year for concealment, and potential fines.
Dugan, 65, was released on bond following her initial appearance in U.S. District Court in Milwaukee before Magistrate Judge Stephen Dries. Her arraignment and plea hearing are scheduled for May 15. She retained former U.S. Attorney Steven Biskupic, who said, “Judge Dugan will defend herself vigorously and looks forward to being exonerated.”
The arrest has sparked varied responses. Milwaukee County Circuit Court Chief Judge Carl Ashley stated that judicial conduct rules prevent him from commenting but confirmed that Dugan’s court calendar would be managed by other judges as needed. Milwaukee Mayor Cavalier Johnson expressed concern that the arrest could deter courthouse attendance, potentially affecting public safety. U.S. Representative Gwen Moore (D-Wis.) called the arrest “shocking” and suggested it may reflect federal overreach, emphasizing the need for a high legal standard in such cases.
Conversely, many officials and Americans supported the arrest. In a Fox News appearance, Attorney General Pam Bondi stated that the action sends a message that no one is above the law, particularly in cases involving interference with federal operations. Wisconsin State Assembly Majority Leader Tyler August (R) indicated that state lawmakers might consider further action if the allegations are substantiated.
The New Mexico arrest
This arrest follows another case involving a former New Mexico judge and his wife, charged with harboring an illegal alien.
Former Doña Ana County Magistrate Judge Joel Cano and his wife, Nancy Cano, were arrested in Las Cruces for allegedly harboring a Venezuelan national linked to the Tren de Aragua gang: Cristhian Ortega-Lopez. He was reportedly hired by the Canos for home repairs and later allowed to reside in their guesthouse.
Court documents reveal that Ortega-Lopez entered the U.S. illegally in December 2023 and was found in possession of firearms, with social media posts showing him posing with weapons. The Canos face charges of evidence tampering, and Joel Cano resigned from his judicial position in March, subsequently being permanently barred from holding any judicial office in New Mexico.
The incidents occur amid ongoing tensions between federal immigration enforcement efforts and local judicial systems, specifically judges who believe they are above the law.
